Maceda Law Explained: A Homebuyer’s Safety Net

Learn how the Maceda Law (RA 6552) protects Filipino homebuyers paying in installments. Discover your rights, grace periods, and refunds explained through a real-life story.

Meet Liza, the First-Time Homebuyer

Liza is a 32-year-old marketing professional from Quezon City. After years of saving, she finally decided to invest in her dream home through a real estate developer’s installment plan. Like many Filipinos, she wasn’t paying in cash or through a bank loan yet—just monthly installments directly to the developer.

At first, everything was smooth. But then, life happened. A medical emergency in her family disrupted her finances, and she started to worry: What if I can’t keep up with my housing payments? Do I lose everything I’ve paid?

That’s where Maceda Law, or the Realty Installment Buyer Act (Republic Act 6552), comes in.

What is Maceda Law

Enacted in 1972, Maceda Law protects buyers of real estate on installment payments against one-sided forfeitures. Instead of immediately losing all your hard-earned payments when you default, this law gives you certain rights and remedies.

Key Benefits of Maceda Law

Here’s how it applied to Liza’s case:

  • If you’ve paid at least 2 years of installments
    • You’re entitled to a grace period of one month per year of installment paid to catch up without additional interest.
    • If you still decide to cancel, you’re entitled to a cash surrender value equivalent to 50% of total payments made.
    • After 5 years of installments, you get an additional 5% refund per year, up to a maximum of 90%.
    • Example: Liza had been paying for 3 years already. She was entitled to a 3-month grace period to settle her missed payments.
  • If you’ve paid less than 2 yearsIf you’ve paid less than 2 years
    • You still get a grace period of at least 60 days.
    • If you fail to pay within that time, the contract can be cancelled, but only after a 30-day notarial notice.
    • Example: If Liza was only paying for 18 months, she would still get 60 days to catch up before cancellation.

Why Maceda Law Matters for Buyers

For Liza, knowing her rights under Maceda Law gave her peace of mind. She didn’t feel powerless against her developer. Even if she struggled financially, she knew she wouldn’t immediately lose everything she had worked hard for.

For many Filipinos, real estate is their biggest lifetime investment. Maceda Law ensures that installment buyers have fair protection against sudden loss.

The Maceda Law is your safety net, ensuring you don’t lose everything if life throws you a financial curveball.
